An Ontario man has been fined $5,000 for illegally operating an aggregate pit on Crown land.

Daniel Desmarais of Vermillion Bay was found guilty of excavating aggregate from Crown land without a permit.

The court heard that during the summer of 2010, Desmarais removed approximately 100 yards of gravel from a pit on Slush Road, off Deer Lake Road, in the Kenora District. He did not have an aggregate permit.

An individual observed equipment in the pit and contacted the Ministry of Natural Resources. Conservations officers followed up with an investigation, which led to the charge.

In Ontario, the extraction of aggregate is regulated and licensed by the Ministry of Natural Resources. Operators require licences and permits that regulate the amount of material removed and how it can be used.

Justice of the Peace Robert McNally heard the case in the Ontario Court of Justice, Kenora, on April 12, 2011.
