Am i able to set my decoys out the night before opening and or the day I want to hunt?

Under the Migratory Bird Convention Act Regulations, the definition of hunt or hunting means chase, pursue, worry, follow after or on the trail of, lie in wait for, or attempt in any manner to capture, kill, injure or harass a migratory bird, whether

or not the migratory bird is captured, killed or injured.

The use of decoys is common practice amongst duck and goose hunters to lure migrating flocks into close range. Hunting is permitted during regulated seasons and at specific times of the day. Having decoys set out before legal time and or the day before the season begins is allowed so long as you are not hunting.

Keep in mind that others are watching what you are doing and you may draw attention to yourselves if it looks like you are hunting before the season begins.
