I had thought that hunting from a motorized vehicle was not legal, therefore if you are not legally able to hunt or carry a loaded firearm, why must you wear an orange helmet? Guest MNR Report post Posted January 26, 2010 If you are on an ATV in an area with wildlife, and you are in possession of a firearm, you are deemed to be hunting. If it’s during a time when there is an open gun season for big game (moose, deer bear) you are required to wear Hunter Orange . “Hunting” has a broad definition and includes “being in search of”. If you’re on an ATV, you need a helmet – if you’re hunting, you need orange (including head cover). You can hunt (be in search of) from a vehicle or boat, but you can’t have a loaded firearm and you can’t discharge the firearm from the vehicle or motorized boat. The Fish and Wildlife Conservation Act also prevents you from using a vehicle or boat to chase/harass/kill/pursue wildlife. You cannot hunt from an aircraft.
