Legalities of higher HP motor

I am wondering if anyone knows of the legalities ie. fines, insurance related issues etc... of putting a larger Hp motor on your boat than what is posted on the tag.

I just bought a Lund 16' model boat and find the 40hp 2 stroke Mariner motor underpowered for this boat yet the tag says max HP 40. It gets the boat up on plane ok with a couple people and gear but when running at speed I find your maxing the throttle cause it just doesn't seem like your going fast enough. Not to mention that maxing it really sucks the gas back when running any distance.

I could see this boat easily taking a 60hp e-tec. This would give me hole shot power (which is very handy in larger waves, I fish big water alot) plus allow me to cut back on the throttle when running.

Anyone have any advice on an issue like this?
