Guest MNR Report post Posted September 28, 2010 The legal owner of a piece of property or someone acting under the direction of the owner (agent) may post a piece of property and restrict either access or an activity or both. That person may enter onto the land and carry out that activity that has been posted as restricted because they own the land. The owner or agent may also give permission to anyone to enter the land and engage in an activity that may be restricted. If the owner has posted it to “No Tresspassing/No Hunting” he and anyone he has given to may enter and engage in hunting. (as long as they are not breaking any municipal/provincial/federal laws). Here’s a few hints on getting permission. Make sure the person giving the permission has the right to do so. Get the permission in writing. Here’s a sample of what a Conservation Officer or Police Officer would like to see: “Joe Blow has my permission to hunt on my property at Lot 3 Con 4 Anywhere Twp for 2010. Signed: Property owner Telephone: xxx-xxxx Ethically, hunters have an obligation to do their homework and know where they are going to hunt, find out if there are municipal by-laws governing discharge of firearms and lastly and probably most importantly, to obtain permission from the landowner if the land is private. Legally, however, under the Trespass to Property Act, a person must be given notice that a certain activity or entry is prohibited. Notice can be given orally, in writing or with signs. A sign with a 10 cm red dot on a white background indicates that entry is prohibited. Land that is a garden, field, fenced, gated or under cultivation, including a lawn, orchard or where trees have been planted does not have to be signed as it is understood that it is private.
